These terms apply to every order placed on smartwhiptanks.ca. Please read them before you buy. By placing an order you accept them.

Who can order
You must be at least the age of majority in your province or territory, and you must be ordering for a business or culinary purpose. We may ask you to confirm this, and we may refuse or cancel any order where we are not satisfied.
What these products are for
Our tanks contain food-grade nitrous oxide intended for whipping and aerating food in kitchens, cafés, bakeries and catering operations. They are sold for food preparation only.
They are not sold for human inhalation and must never be inhaled. Misusing nitrous oxide is dangerous and can cause serious or permanent harm. We will refuse service to anyone we believe intends to misuse these products, and we may cancel an order at any point before dispatch.
You are responsible for using, storing and transporting the product lawfully and safely, and for complying with any rules that apply where you are. Cylinders are under pressure: keep them upright, below 50 °C, away from heat and direct sunlight, and out of reach of children.
Prices and currency
- All prices are in Canadian dollars (CAD).
- Prices can change at any time, but a change never affects an order we have already accepted.
- If a product is listed at an obviously incorrect price, we may cancel the order and refund you in full rather than supply at that price.
Minimum order
There is a minimum order of $250 before shipping. The cart will tell you if you are short and by how much. This is a wholesale-weight product and the minimum keeps freight viable.
How an order is formed
Placing an order is an offer to buy. A contract exists only once we confirm the order and accept your payment. We may decline an order for any lawful reason, including stock, delivery address, suspected misuse or a failed verification.
Payment
We accept Interac e-Transfer and cash on delivery.
- Do not send an e-Transfer until we contact you. After you order, our support team sends you the transfer details directly by WhatsApp or email.
- We never publish transfer details on this website. If you see them posted publicly anywhere claiming to be us, do not send money — contact us first.
- Your order stays on hold until payment clears, and we prepare it for dispatch once it does.
- A phone number is required at checkout because this process depends on us being able to reach you.
Delivery
- We sell and ship within Canada only.
- Ten provinces: $24.95 standard delivery, and free over $350.
- Yukon, Northwest Territories and Nunavut: $39.95, with no free-delivery threshold.
- Delivery estimates are estimates, not guarantees. We are not liable for delays outside our control, such as weather or carrier backlogs.
Risk passes to you on delivery. Ownership passes once we have received payment in full.
Changing or cancelling an order
You can cancel before dispatch for a full refund — email support@smartwhiptanks.ca as soon as you can. Once an order has shipped, our refund and returns policy applies.
If something is wrong with your order
Tell us within 48 hours of delivery if anything arrives damaged, short or incorrect, with photographs where you can. See the refund and returns policy for how that works.
Our liability
Nothing here limits liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be limited.
Otherwise, and to the extent the law allows, our total liability for any order is limited to what you paid for it, and we are not liable for indirect or consequential loss such as lost profit or lost business. We are not liable for any loss arising from use of the product other than for its intended food-preparation purpose.
Your account
Keep your account details secure and accurate. You are responsible for activity on your account. Tell us promptly if you think someone else has access to it.
Governing law
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there.
Changes to these terms
We may update these terms. The version published when you place your order is the one that governs it.
